IMSS clarifies about pension cuts

February 4th, 2019

The director of the Mexican Institute of Social Security (IMSS), Zoé Robledo, said in a morning conference that the ceiling of 25 minimum salaries for the pension of workers of the so-called "Transition Generation" will be maintained.

Robledo's statements are given after the thesis controversy issued by the Second Chamber of the Supreme Court of Justice of the Nation (SCJN) on the recalculation in pensions is not a sentence for social security institutions, but “a criterion for the lower courts and collegiate courts ”.

During the morning conference of Andrés Manuel López, Robledo explained that “it is not a general scope of application, it is a criterion for the courts, where they have to solve, it is where there are lawsuits, it simply does not apply to Social Security. In that sense, the pension of people who are in the transition model will be calculated at 25 salaries, in respect to the work they have already done ”.

Therefore, the IMSS will continue to calculate the pensions of people who are in the transition model between the laws of 1973 and 1997 at 25 minimum salaries, as has been done in recent years.
