During the years 2011 to 2018, that is during the government of Eruviel Ávila and with the management of Attorney General Alejandro Gómez Sánchez, people have been unjustly imprisoned to improve the official image, according to the report "Edomex: Fabrication of culprits ", Carried out by Mexicanos Contra la Corrupción y la Impunidad together with journalists from La Silla Rota portal.

The reason for the fabrication of guilty parties, which almost always involved torture, weapons or false evidence and "sown" in the accused and collusion with the State Judicial Branch, was to increase the number of convictions to raise efficiency rates and defend progress of his government in public security. This, of course, fell in the face of reality: kidnappings doubled between the first and fifth years of the administration of Eruviel Ávila, and between 2015 and 2016 malicious homicides were triggered.

70% of detainees from the State of Mexico who were prosecuted were sentenced and were sentenced to prison terms between 2011 and 2017, the report said.

The statistics of this period reveal that of the 26 thousand 542 trials that had a sentence, 82.6% were condemnatory and 16.2% absolutist, that is to say only 4 thousand 246 people were released.

Example of false guilty were Isidro Rivero, Alejandro Sánchez and Daniel Ramos, masons of Nezahualcoyotl who were at home in 2014 when state and municipal police of the Mixed Operations Base (BOM), along with soldiers, raided the property, tortured them and they raped with weapons and presented before the Public Ministry of the municipality on charges of assault with an armed hand.

Like them, many cases ended up in informal pre-trial detention, which meant waiting for the judicial process and determination of the judge inside a prison, completely violating not only their human rights, but also the basic premise of the presumption of innocence, despite that the New Criminal Justice System in Mexico (implemented in the government of Ávila) sought to make a fair emphasis on this issue.

Thus, the Office of the Prosecutor (until 2016 Attorney General of the State of Mexico) was responsible for fabricating the crimes against the accused from the Public Prosecutor's Office, to be later endorsed by the state judicial power, despite multiple irregularities and obvious inconsistencies. That is, the two instances of justice sought their efforts to invent guilty, instead of administering justice to true culprits, something that, as is common knowledge, abound in the entity.

An example of the irregularities mentioned is that, in the 25 files analyzed by La Silla Rota. None of the agents involved in the arrest were identified. Another one, in 64% of the cases, during the hearings it was recurrent that the accusing party (or alleged accuser) was not present and despite this, the judicial process against the detainee continued. In almost half of the cases, the detainees claimed to be victims of torture to "confess" their guilt, or accept that they were members of some criminal organization.

The accusations against the FGJEM and the PJEM continue to be received for the same reason, often protected by human rights violations, such as recently occurred with the recently released indigenous people of Salazar and those of San Pedro Tlanixco. As for the files, 26 of 44 cases were released, at the cost of staying more than a year in prison and later prove their innocence.

It should be noted that the Prosecutor Alejandro Gómez, who worked during the management of Eruviel Ávila still remains in office under the protection of the current Governor Alfredo del Mazo. Same case occurs with Fernando Ulises Cárdenas, central legal prosecutor and who appeared in a video in 2015 asking his employees an 80% effectiveness in the trials, justifying the manufacture of guilty: "Of 10 cases they have to win eight and lose two ... That crimes are invented? That's life-long, man! "
