Mexico City, May 13, 2020

On May 11, the “Agreement by which the permanent Armed Force is available to carry out public security tasks in an extraordinary, regulated manner, supervised, subordinate and complementary ”was published in the Official Gazette of the Federation in support of certain functions of the National Guard.

The Office in Mexico of the United Nations High Commissioner for Human Rights (UN-DH) recognizes the important security challenges facing the country and the painful consequences faced by the population for the actions of organized crime. In this framework and in full harmony with international human rights mechanisms, the UN-DH has reiterated on numerous occasions that the participation of military forces in security tasks must comply with criteria of strict exceptionality and be the last resort, ensuring the civil nature of security corporations. The foregoing, given that the security strategy established since 2006 has evidenced its dysfunctionality to reduce violence and increase human rights violations.

Although the intervention of the Armed Forces in public security tasks is foreseen - under certain circumstances - in the fifth transitory article of the constitutional reform created by the National Guard, the published Agreement does not contain information or provisions that allow evaluating its conformity with the constitutional and international standards in the matter.
