The municipal government of Toluca, headed by Morena's panista, Juan Rodolfo Sánchez Gómez, maintains at least one hundred direct advertising awards in different forms of secrecy and opacity, printed, digital and visual, assigned for the same number of suppliers during 2019, thus violating Article 92 of the Law of Transparency of the entity, which obliges all authorities, to transparent the use of public resources in the field of social communication, with details of the provider and contract amounts.

In addition to hiding the amount of contracts for companies and individuals in the field of advertising, the government of the Mexican capital does not provide or exhibit any documentary that supports a supposed “generic” investment of 49 million pesos, which the year assures Lastly, in terms of social communication, as read in a footnote of all records of suppliers contracted for advertising, on its transparency page, so there is no certainty that this amount is the real one.

In the brief note, which is intended to justify the opacity, it indicates that: “Regarding the data related to contracts, amounts, and invoices, this area does not have information in compliance with the provisions of the 2019-2021 Municipal Regulatory Code of the Municipality of Toluca, the General Coordination of Social Communication has as its attribution in Article 3.8 Planning, organizing, directing and evaluating the activities entrusted to it in the area under its charge, based on the policies and priorities established for the achievement of the objectives and goals of the municipal government; and as the main function Planning and implementing, in coordination with the municipal administration units, specific communication campaigns, which is why it is only the requesting area of ​​the various administrative, purchasing and payment control areas, so it does not have related information to these fields. "

However, the Transparency Law of the State of Mexico clearly states in its section 27 of article 92 on the obligations of municipalities in the field of social communication, indicating that it should be made available to the public, permanently, updated, simple, precise and understandable, among other things (section XXVII): The amounts allocated to expenses related to all programs and campaigns of social communication and official publicity broken down by type of medium, suppliers, contract number and concept ”.

Despite what the law says, the head of the area of social communication, expansionist or PAN, Marco Antonio Aguilar Sánchez, omits his responsibility in terms of transparency, only putting the note referred to in the more than 60 records related to media and placing as justification, an internal regulation above what dictates the state transparency law.
