After spending a year unjustly imprisoned in the Chiconautla Prison, for facing an assailant who tried to strip him of a violin that is his means of work, Don Lucio Yáñez García obtained his freedom this Friday, after deputy Faustino de la Cruz Pérez asked Attorney General Alejandro Gómez to review the case and grant the release.

The legislator celebrated the freedom of Don Lucio but regretted that the case was attended until it was national news and pressures were made to bring the issue to the congress because it is clear that there is no justice for the poorest like Don Lucio, 75, who He keeps the few resources he gets from playing his violin in the streets.

On February 13, 2019, a man tried to strip the Otomi musician of the violin but when he refused he was threatened with a weapon and received a hit that burst his ear so that in self-defense he injured the assailant with a razor but was arrested and processed for injuries.

"Why did they not attend the case before to release him, but until a legislator intervenes so that justice is done to an elderly, destitute and resourceless adult who only defended his source of work," said the deputy.

Jaqueline Priego, legal representative of the Union of Mariachis and Norteños de Ecatepec and legislative advisor, stressed that the deputy learned of the case of the older musician unjustly imprisoned, by a note on television, and indicated that measures should be taken to address the legal process and it would cover the bond although, in the end, it was the Office of the Ombudsman who did it.

Priego added that the legislative office will also follow up on Don Lucio's situation after his release so that authorities grant him protection measures as an older adult.

"We are going to request the necessary protection measures given that this situation, in addition to being a media, puts it in a certain vulnerability, we are going to request protection measures through the prosecution," he said.

They will also ask that all their fundamental rights be restored, a procedure will be made to obtain all the benefits of the elderly, and find a shelter where they are in a shelter.
